转自:闪电新闻 近日,湖北武汉,二房东看店铺生意好要求涨7000元租金,被租客拒绝后连夜清空包子店,老板娘站在门口手足无措。据店主透露,他与二房东签订了一份为期三年的租赁协议,协议规定租金为每年一万元。近期二房东却突然提出要大幅度提高租金,店主断然拒绝后,二房东竟然强行将店内所有物品搬离,导致店铺无法正常营业。此事一出,许多市民纷纷表示愤慨,认为二房东的行为不仅违反了法律法规,更严重侵犯了商铺业主的合法权益。 对此,广东知恒(济南)律师事务所李云燕律师从法律角度进行了分析和解读: 本事件中涉及的法律问题主要有两个: 一、房东突然涨房租是否一定构成违约? 第一种情况,房东在租赁合同有效期内突涨房租无合同和法律依据,构成违约。根据民法典第七条、第五百零九条的规定,民事主体从事民事活动,应当遵循诚信原则,秉持诚实,恪守承诺。当事人应当按照约定全面履行自己的义务。租赁期限内,房东应秉承诚信原则,按照合同约定的金额收取租金并租赁房屋。根据民法典第五百七十七条、第五百八十二条、第五百八十三条的规定,当事人一方不履行合同义务或者履行合同义务不符合约定的,应当承担违约责任。具体违约责任应当按照当事人的约定承担。对违约责任没有约定或者约定不明确的,在履行义务或者采取补救措施后,对方还有其他损失的,应当赔偿损失。 第二种情况,房东在租赁合同到期时提出涨房租,不构成违约。租户有权根据自己的实际情况选择是否续租。如果认为租金过高,可以选择不再续租,并按照约定时间搬离。如租户未在约定时间搬离,应承担违约责任。 第三种情况,房东与租户之间的租赁期限为不定期,房东提出解除原合同,就新租赁合同提出新的租金标准不构成违约,但应在原合同解除的合理期限前通知对方。根据民法典第七百零七条、第七百三十条的规定,租赁期限六个月以上的,应当采用书面形式。当事人未采用书面形式,无法确定租赁期限的,视为不定期租赁。对于不定期租赁,当事人可以随时解除合同,但是应当在合理期限之前通知对方。房东提出解除合同,应在合理期限前通知租户,尽到通知、协助义务,否则构成违法。 二、房东私自将租户的物品清空,应承担什么法律责任? 根据上述三种情况,分别处理。如属于上述第一种情况,房东无权单方涨房租,且构成违约。租户有权要求房东继续履行原合同,并承担违约责任,将包子铺的物品搬回,赔偿租户因此产生的经济损失。 如属于第二种情况,双方的租赁合同终止,租户应在约定期限内搬离,如租户未能搬离,房东可要求租户承担违约责任。如房东在约定的搬离期限内私自将租户的物品清空,则属于侵权行为。应承担损害赔偿责任,赔偿租户因此产生的财产损失。 如属于第三种情况,房东可以解除合同,但应在合理期限前通知租户,给出租户合理的搬离时间。房东在不提出解除合同或者房东提出解除合同但不给租户合理期限搬离,未尽到通知、协助义务,违反民法典第七百三十条的规定。房东私自清空租户物品属于侵权行为,应对租户产生的损失承担赔偿责任。 诚实守信是中华民族的传统美德,也是我国社会主义核心价值观的重要内容。诚实信用原则是民事活动的基本原则。合法有效的合同对当事人具有法律约束力,当事人应遵循诚信原则,恪守契约精神,全面履行合同义务,切勿因一时私利单方毁约或擅自涨价。租金应当依据市场标准、租赁期限、支付方式、使用范围等进行约定。同时,租金、租期等关键内容应在租赁合同中进行明确、详细的约定。当事人还要保存好相关的主体信息、合同原件、付款凭证、沟通信息等,以便发生纠纷时更好地维权。 闪电新闻记者 郝彬洁 报道
